METTLER TOLEDO
As used herein, " the Company is understood to mean Metiler-toledo(Changzhou)Scale &System
Co.Ltd.本条款中所指公司'指梅特勒一托利多(常州)称重设备系统有限公司。
The following terms and conditions shall apply to all service performed for Buyer, including Call
Service and Contract Service. Call Service is all field service not performed under an existing
contract. The Buyer understands thaf the terms and conditions sef forth below shall be controlling
and any additional and/or inconsistent terms and conditions set forth in any acknowledgment
purchase order, or acceptance documents requested from and/or provided by the Buyer shall be of
no force or effect
下列条款和条件适用于为买方提供的所有服务,包括单次收费服务和服务合同。单次收费服
务是指服务合同以外的所有现场服务。任何其他条款或声明、订单及买方要求提供的或自己
提供的其他材料中与下述条款相矛盾的条件或条款均不发生法律效力。
RATES/PRICES价格
Rates to be charged for services to be performed are those set forth in the Companys published
and currenly issued price lists. Rates/prices for services not covered under contract shall be
those in effect at time of providing services. Prices for billable parts shall be those in effect at the
time of installation in Buyers equipment
公司“提供的服务价格标明在公司"公布或发行的价格单上。公司提供的服务合同以外
的现场服务的价格应以提供服务时的公司的收费标准为准
公司"的价格不包括任何有关的检定费、许可费等
2. PAYMENT TERMS付款条件
Except as otherwise specified herein, terms are nef cash. In addition, the Company shall be
owed to the Company be more than thirty(30) days past due. In the event
under no responsibility to send a service representative to the Buyers facility should the bala
initiates any legal proceedings to collect any amount owed by Buyer, the Buyer agrees to pay all
of Company's reasonable legal fees and expenses
除非合同另有规定,否则付款条件一律为现款支付。另外,如果买方超过30天未能付清
所欠公司"的款项.“公司”无义务向买方工厂派出维修工程师。如公司“采取法律措施收
取款项.买方同意承担因此而发生的律师费及其他费用
3. WARRANTIES质量保证
A. SERVIC服务
The Company warrants that the service shall be performed in a workmanlike manner in
conformity with standard industry practice. Should any nonconformity be detected within 30
days after the work is completed and prompt notification thereof is made by the Buyer in writing
to the Company, the Company Will supply the necessary service, direction or consultation to
correct the nonconformity. There are no ofher warranties, express or implied.'公司承诺将以
