摘要:随着2003年1月1日《政府采购法》的颁布实施,明确将工程纳入了政
府采购的范围,我国政府构成采购制度已经逐渐走上了法制化、规范化的道路,
工程采购在政府采购中的比重逐渐扩大,从中央到地方政府工程采购制度己经初
步建立。但是,在目前我国的政府工程釆购实践中还存在着法律法规体系不完善
工程采购范围不统一、管理体制不科学、缺乏有效的监督救治机制、采购队伍不
健全等诸多问题。这就迫切要求尽快完善建立既适合我国国情,又体现国际惯例
的政府工程采购制度。
论文在简要介绍政府工程采购基本理论的基础上,重点分析了美国、英国
我国香港地区和WTO《政府采购协议》等发达国家和地区的工程项目政府采购制
度与国际规则,总结归纳了国外工程项目政府采购制度的特征及对我国的借鉴和
启示。研究了我国工程项目政府采购实践,并从工程项目政府采购法制化建设、
管理体制、招投标采购、监督机制、配套制度和基础性工作等方面分析了我国工
程项目政府采购实践中存在的题及问题产生的根源。总结分折了目前我国政府
工程采购中存在的主要问题,藉此探索建立具有中国特色的政府工程采购制度。
在前述硏究的基础上,从健全法规体系、改革现有管理体制、完善招标投标
制度、做好配套制度改革和基础性工作等方面提出了完善我国政府工程采购制度
的建议,并指出了有待进一步研究的问题。

ABSTRACT
ABSTRACT With the promulgation and implementation of" the government
procurement law on January I, 2003, the Government Procurement act of China has
definitely brought engineering into the scope of govemment procurement. Chinas
govemment procurement system has been gradually moving toward a legal and
standardized way, the proect procurement of govemment procurement in the proportion
radually expanded, from central to local government procurement system has been
initially stablished However, at s time r gemet procurment practice still
filled with many problems, such as imper ect legal system engineering procurement not
nified, unscientific management systems, lack of effective supervision and mechanism,
and many other issues. All of these urge to establish a government project procurement
system with Chinese characteristics which also accords with international practice.
After introducing the basic theory of govemment project procurement, this paper
attaches importance to analyze the govemment project procurement system of such
developed countries as America, Britain, Hong Kong and the Wtoagreement on
Government Procurement", then it sums up the features of foreign government project
procurement system and international regulations, and the inspiration to China from the
both. Next, the paper carries out comparative analysis on Chinese govemment project
procurement practice, through the aspects of Building the legal system, management
system, bidding procurement, and supervision mechanisms, and the supporting system
and infrastructure work
On the basis of analysis above, the paper put forward the sug estion of perfecting
Chinese govemment project procurement system through the following aspects: perfect
laws and regulations, reform the existing management system and perfect the bidding
system, doing well ordinated system reforms and basic work. And at last, the paper
points out the questions that need further research.
